1. Who we are and what these Terms cover

1.1 Your provider. VIDify Consulting LLC, a Delaware limited liability company trading as Therapeutic Stretching, operates the Site. Our address is 300 Creek View Rd, Ste 209, Newark, DE 19711, USA and our email is support@therapeuticstretching.com. In these Terms, “we,” “us” and “our” mean VIDify Consulting LLC; “you” means the individual using the Site or booking a call.

1.2 The Site. The “Site” is www.therapeuticstretching.com, including its booking form. These Terms cover your use of the Site, the inquiries you send us and the calls you book through it.

1.3 Purchases are separate. Nothing is sold on the Site. If you decide to buy a coaching program (“Program”) after a call, that purchase is a separate agreement governed by the terms presented to you at checkout. These Terms do not govern Programs, the client app or payments.

1.4 Consumer rights take priority. These Terms do not exclude any right or remedy that the law that applies to you does not allow us to exclude.

2. Accepting these Terms

2.1 Using the Site and booking a call. By using the Site you agree to these Terms. When you tick the acceptance box on the booking form and submit it, you accept these Terms. Booking does not commit you to buy a Program, authorize a payment or start a paid Program.

2.2 Privacy and separate choices. Our Privacy Policy explains how we handle personal information. Our Consumer Health Data Policy explains how we handle health information. Accepting these Terms is not the same as giving the consents described in those policies.

3. Eligibility and accurate information

3.1 Eligibility. You must be at least 18 to book a call. We do not offer Programs to residents of the Province of Quebec, Canada.

3.2 Accurate information. Give accurate contact and booking information, and tell us if something changes. This does not oblige you to give optional health information.

4. The booking form and sales calls

4.1 Booking communications. We use the contact details you give us to reply to your inquiry and manage your call, including confirmations and reminders. Booking does not sign you up for marketing, and it does not authorize unrelated automated marketing calls or texts.

4.2 Health information. The questions about pain, injuries and limitations on the booking form and on the call are optional. We ask for your separate consent before we use your answers. We use them only to prepare your call and to judge whether a Program suits you, as described in the Privacy Policy and the Consumer Health Data Policy. Accepting these Terms is not, by itself, consent to the processing of your health data.

4.3 Recording, transcription and AI notes. Sales calls take place on Google Meet. They are recorded and transcribed, and Google Gemini prepares notes. Google Meet shows this on screen while it is active. If you do not want the call recorded, tell us before or at the start of the call and we will switch recording off. The call can continue without it. Agreeing to a recording is separate from any consent needed to process health information you discuss on the call.

4.4 No obligation to purchase. The sales call does not oblige you to buy anything. Its purpose is to discuss your inquiry and our Programs. It is not a medical assessment, diagnosis or treatment.

5. Site content is not medical advice

5.1 Education only. Content on the Site is general education about stretching and movement. It is not medicine, physical therapy or any other licensed healthcare service. It is not meant to diagnose, treat, cure or prevent any disease or condition. Mariia Rybachuk is not a licensed medical or physical therapy professional. Do not use Site content in place of appropriate medical care, and do not ignore professional medical advice because of it.

5.2 Emergencies. In an emergency, contact your local emergency services. Our booking form and email are not emergency channels.

5.3 Results. Testimonials and results shown on the Site are individual experiences. They do not guarantee a particular improvement, reduction in pain or other result.

6. Communications

6.1 Booking messages. We send the communications needed to manage your booking, including confirmations, reminders and rescheduling notices. Please keep your contact details up to date.

6.2 Marketing. Marketing is governed by the Privacy Policy and the consent rules that apply to it. You can unsubscribe from marketing at any time. These Terms do not authorize marketing texts, automated marketing calls or advertising tracking.

6.3 Booking texts. When you continue on our booking form, where booking texts are named under the button, or text YES to our number, you agree that Therapeutic Stretching (VIDify Consulting LLC) may send automated text messages about your booking to the number you gave: a follow-up if you have not yet chosen a time, booking confirmations, reminders, and cancellation or rescheduling notices. We do not send marketing texts. Message frequency varies with your bookings. Message and data rates may apply. Reply STOP at any time to stop texts; we send one confirmation and nothing further, and you can reply START or YES to resume. Stopping texts does not cancel your booking; we continue by email. Reply HELP or email support@therapeuticstretching.com for help. Mobile carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle your number.

7. Our content and use of the Site

7.1 Ownership. The Site and its content, including text, videos, images, our name and logo, belong to us or our licensors. You may view the Site for your own personal, noncommercial use.

7.2 Restrictions. Do not copy, republish, sell, distribute or modify Site content, or use our name, logo or materials, without our written permission. This does not remove any copyright exception or other right that applicable law gives you.

7.3 Acceptable use. Do not submit false bookings or someone else’s information, and do not try to interfere with or disrupt the Site.

8. Site availability

We may update, change or suspend the Site at any time. We do not promise that it will be uninterrupted or error-free.

9. Liability

9.1 Liability we do not exclude. We do not exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for deliberate wrongdoing, or for any other liability that applicable law does not allow us to exclude.

9.2 Limit. The Site and booking calls are free of charge. To the extent the law where you live allows, and except for the liabilities in section 9.1, our total liability to you in connection with the Site is limited to USD 100.

10. Changes to these Terms

We may update these Terms. The version posted on the Site, with its “last updated” date, applies from the date it is posted. A change does not apply retroactively to a call you have already booked.

11. Complaints, applicable law and courts

11.1 Complaints. Contact support@therapeuticstretching.com about any problem. You do not have to complain to us before contacting an authority or bringing a claim, and complaining to us does not postpone any legal deadline.

11.2 Applicable law. Delaware law governs these Terms only to the extent that this choice is permitted. It does not take away the mandatory protection of the law where you usually live.

11.3 Courts. You may bring a claim in the competent courts where you live or in Delaware. These Terms do not require arbitration or waive any right to take part in a class or collective action.

12. General provisions

12.1 Invalid terms. If a provision cannot be enforced, applicable law decides how that affects the rest of these Terms.

12.2 Enforcement. A delay in enforcing a right does not, by itself, waive that right.

12.3 Notices. We send notices to the email address you give us. Send notices to support@therapeuticstretching.com or to our postal address in section 13.
