These Terms and Conditions (the "Terms") govern your access to and use of the website located at https://www.therapeuticstretching.com/ (the "Site"), operated by Classes with Manitta ("we", "us", "our"), a business established and operating from the Republic of Panama.

By accessing or using the Site, you ("you", "the User", "the Visitor") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Site.

We are based in the Republic of Panama and provide services to clients located anywhere in the world, subject to these Terms.

2. Nature of the Site and services

The Site is informational. It describes the classes, coaching, and related services we offer (collectively, the "Services") and provides a direct WhatsApp link so prospective clients can contact us.

No transactions take place on the Site. You cannot purchase, book, or pay for any Service directly through the Site. All bookings, quotes, scheduling, and payment arrangements occur through WhatsApp or other channels agreed between you and us, and are governed by the separate agreement we reach with you at that time (the "Service Agreement").

These Terms govern your use of the Site only. They do not constitute the Service Agreement and do not create any obligation on either party to enter into one.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher), to use the Site or contract Services. If you are contracting Services on behalf of a minor, you confirm that you have the legal authority to do so.

When you click the WhatsApp link on the Site, you are redirected to the WhatsApp application or web service, which is operated by Meta Platforms, Inc. and governed by its own terms and privacy policy. We are not responsible for WhatsApp's services or how Meta processes your data once you initiate a chat. Information you send us via WhatsApp is processed as described in our Privacy Policy.

6. Intellectual property

All content on the Site — including text, graphics, logos, images, course outlines, photos, videos, and the overall design — is owned by Classes with Manitta or licensed to us, and is protected by Panamanian and international copyright, trademark, and other intellectual property laws.

The name "Classes with Manitta" and any associated logos are our trademarks. You may not use them without our prior written consent.

Our total aggregate liability arising out of or relating to your use of the Site is limited to USD 100 (one hundred U.S. dollars). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law (including, where relevant, liability for fraud, gross negligence, or willful misconduct).

10. Indemnification

You agree to indemnify, defend, and hold harmless Classes with Manitta and its owner, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• your misuse of the Site;

• your violation of any law or third-party right.

These Terms are governed by and construed in accordance with the laws of the Republic of Panama, without regard to its conflict-of-laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Site will be submitted to the exclusive jurisdiction of the competent courts of Panama City, Republic of Panama, except where mandatory consumer protection laws of your country of residence grant you the right to bring proceedings in your local courts.

The 1980 United Nations Convention on Contracts for the International Sale of Goods does not apply.
